Cyber Courts: Justice in the age of the Internet Era

Technology is advancing and evolving to a whole new level. We have reached the stage where AI has attained the ability to replace humans. CYBER COURT is the perfect example for this.

AI has been doing great in the business sector. It has brought numerous advancements in the market structure. AI has now entered into the legal aspects to make it much more advanced with its efficiency. China has created and started dealing with the Cyber courts. Now, these cyber courts do not deal with all kinds of cases. These only deal with e-commerce and internet-related issues. China has the largest internet-using population. This country believes in fastening the whole process of providing justice with the help of digitalization in courts for the betterment of its population. The cyber court is a solution that China has come up with to tackle the delay in a large number of cases. This mobile court has solved more than 3 Million cases until now. Hangzhou, the e-commerce capital of China was the first one to open these digital courts. Cyber courts deal with the following cases:-

  • ISP AND ICP contacts related disputes
  • Online Copyright Infringement disputes
  • Cases from Online Shopping of Goods and services
  • Disputes of product liability of sellers arising from online sales
  • Cases in regards to online financial loans

 

In order to use this platform, people will have to get their identity verified and then register for the account. For the registration, either physical presence in the Hangzhou court is required or one can verify the identity and then register through the Alipay app. The Supreme Court has given Regulations on Issues of Case Hearing of Internet Court. The electronic data submitted by the parties will be verified trusted timestamp, through electronic signature, hash value checks, blockchain and other evidence collection, hash value check, fixed and tamperproof technical means or through electronic forensic evidence platform certification.  The Chinese Supreme court and the government have allowed cyberspace and technologies like cloud computing, blockchain to form a Mobile court offered on a very famous social media application, WeChat. This court operates by featuring an online interface in which litigants appear by video chat. The on-screen AI judge asks them to present their respective cases. The litigants can register their complaints online and then log in on their court hearing. China has extended this technology to its other 12 regions and provinces. China has put together simple functions and has come up with something that will not only reduce the burden of the judiciary by reducing the backlogs and speeding the whole process but also will provide people justice swifter than evermore.

Is India planning to use this technology to aid the Judicial system here?

 

CJI SA Bobde passed a statement that Technologies such as AI could help deliver justice swiftly. He believes that involving the role of AI would lead to better management and faster results. He also believes like other technologies this system can have negative impacts on the system and thinks that it isn’t a good idea to risk it with the Judiciary system of India. The Chief justice said that India is not willing to replace a Human Judge with AI yet. However, AI can be of huge help for reading hundreds and thousands of documents and providing with answers. In India as per the norms set by the Supreme court of India e-filing is permitted. However online adjudication of cases is not permitted and is the need of the hour. Bringing AI into Judicial matters, may reflect dark human biases. Any defect in the system may lead to sending the wrong people into the jail, the pace of the defect may be difficult to rectify in the future. Machines cannot exercise liberty and creativity hence the decision-makers believe that they shouldn’t be given complete independence.
